Terms and Conditions
The agreement between you and Kafein for using the Kafein website, the Kafein app and the loyalty service behind them.

1. About these terms
These Terms and Conditions (“Terms”) are an agreement between you and Kafein (“Kafein”, “we”, “us”) covering the Kafein website at kafein.my, the Kafein app, and the loyalty services we provide through them (together, the “Service”).
By registering your interest, creating an account, or using the Service, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business. If you do not agree with these Terms, please do not use the Service.
How we handle personal data is set out in our Privacy Policy, and money back is covered by our Refund Policy.
2. Who can use Kafein
Merchant accounts are for businesses operating lawfully in Malaysia, and the person registering must be 18 or older and authorised to accept these Terms for the business. Customer access is for individuals collecting rewards at a shop that uses Kafein. Kafein is not intended for children under 18.
3. Your account
Your owner account is personal to you. Keep your login details secure, use a password you don’t reuse elsewhere, and don’t share owner access. Add staff as their own accounts so every scan is traceable — each staff account is under your control as the merchant, and you are responsible for what happens through your accounts. Tell us promptly at hello@kafein.my if you believe someone has accessed your account without your permission.
4. What Kafein does
Kafein puts a shop’s loyalty programme on its customers’ phones. Depending on your plan, that includes a digital stamp card or points balance, a shop QR code customers scan at the counter, rewards you configure, deals and promo codes, push notifications, customer audiences, and reporting on visits and redemptions.
We provide the platform; we are not a party to the loyalty programme itself. The reward, its conditions and fulfilling it are between the shop and its customer. We may add, change or retire features as the Service develops, and we will give reasonable notice of changes that significantly affect how you use Kafein.
5. Before public launch
Kafein is being rolled out shop by shop. The features, plan limits and prices shown on this site describe our plans for the launch release and may change before general availability. Registering your interest is not a subscription: it does not create a right to a particular price or feature, and it is not a contract to provide the Service. We confirm your plan and price with you before anything is charged.
6. Your responsibilities as a merchant
- Set your reward rules accurately, and honour the rewards your customers have earned.
- Keep your shop details, reward settings and staff list up to date.
- Only message customers who have agreed to hear from you, and act on opt-outs promptly — including WhatsApp and push notifications.
- Give your customers a privacy notice that explains what you collect and why. You decide why your loyalty data is collected; we provide the system that runs and stores it.
- Use the Service lawfully, including under the Personal Data Protection Act 2010, the Communications and Multimedia Act 1998, and Malaysian consumer protection law.
7. Customer data
Each shop runs its own loyalty programme. That shop decides what it collects from its customers, why it collects it, and who else can see it; we process that data to run the Service for the shop. We act for ourselves — as the data user — for our own account, billing and website information.
If one of your customers asks you to correct or delete their data, handle it as the shop running the programme, and tell us if the record also needs to come out of Kafein. Our Privacy Policy explains the detail.
8. Your content and our intellectual property
You keep ownership of your shop content, staff and customer records, and the reward rules you configure. You give us the licence we need to host, process, display and transmit that content in order to run the Service and support you.
We and our licensors own the Kafein app, website, brand, design and software. These Terms do not transfer any of that to you. Please don’t copy, resell or present Kafein as your own product.
9. Fees, billing and renewals
- Plans and prices are shown in the Pricing section and are charged per shop, in Malaysian Ringgit (MYR).
- You choose how you pay: monthly, or yearly where a yearly rate is offered — twelve months paid up front, at a lower effective monthly rate. Either way the subscription is billed in advance and renews automatically for the same period until you cancel. Kafein does not take a cut of your sales, and there is no setup fee.
- Prices exclude any taxes that apply, which we will add where they do.
- We may change prices with at least 30 days’ notice. If you don’t accept a price change, cancel before it takes effect.
- If a payment fails we may retry it, and we may pause the Service until it succeeds.
- The founding merchant offer is a free move up to Growth when it launches, for shops that subscribe to Pro on it: three months prepaid for RM100, or twelve months for RM300. It is not a price lock and it is not transferable. The three-month plan is an entry price, not a standing rate — when those three months end it renews at Pro’s standard monthly rate.
- Refunds are handled under our Refund Policy.
10. Fair use
Please don’t use the Service to:
- break the law, or mislead, spam or harass anyone;
- upload malware, or attack, overload or probe our systems or another shop’s;
- reverse engineer or copy the Service, except where the law allows it;
- scrape or harvest customer data you aren’t entitled to; or
- resell, sublicense or white-label Kafein without our written agreement.
11. Availability and support
We work to keep Kafein online and quick, but we don’t promise uninterrupted service. There will be maintenance and updates, and occasionally something breaks — including at providers we rely on for hosting, database and notifications. We aim to warn you about planned downtime that affects your shop, and we answer support email during Malaysian business hours, Monday to Friday, excluding public holidays.
12. Suspension and ending your account
We may suspend or end your access if you breach these Terms, don’t pay, use the Service in a way that puts another shop or customer at risk, or if the law requires it. Where the problem is fixable, we will tell you what it is and give you a reasonable chance to fix it.
You can close your account at any time by emailing us. When an account ends we will keep your data available to export for a reasonable period, then delete or anonymise it as described in our Privacy Policy. Sections that by their nature should survive — data, liability and governing law — continue to apply.
13. Disclaimers
Kafein is provided as is and as available. We don’t guarantee that your loyalty programme will bring a particular number of customers, visits or revenue — that depends on your shop, your reward and how you run it. We also don’t control what customers do with the rewards you issue. Nothing in these Terms excludes a guarantee or right you have under Malaysian law that cannot be excluded.
14. Our responsibility to you
To the extent the law allows: we are not liable for indirect or consequential loss, lost profit, lost goodwill, or lost or corrupted data where the loss was not caused by our failure; and our total liability for all claims relating to the Service is limited to the fees you paid us in the three months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law.
15. Your responsibility to us
You agree to cover us for claims, losses and reasonable costs we face because of your breach of these Terms, the reward rules or promises you make to your customers, content you upload, or your handling of customer data — including messaging someone who never agreed to hear from you.
16. Changes to these terms
We may update these Terms as the Service evolves. We will publish the new version here with a new “last updated” date, and for material changes we will tell you by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction. If we disagree about something, please email us first — we would much rather sort it out directly.
